- The Entrepreneur operating the online shop under the Internet domain Hendi.com , hereinafter referred to as “Online Shop”, is HENDI Polska Sp. z o.o Firmowa 12 street 62-023 Robakowo, NIP 7792270344, REGON 300143173, KRS0000928027 .
- You can contact the Online Shop by e-mail-address or telephone number available at Hendi.com .
- The Terms and Conditions specify the rights and obligations of the Customers, as well as rights and obligations of the Seller as an entity managing and operating the Online Shop.
- The Terms and Conditions are available in Polish and English language.
- The Customers are obliged to observe the proprietary copyrights and rights resulting from the registration of inventions, patents, trademarks, utility and industrial models.
- The owner of Hendi.com is obliged to provide legal and organisational measures necessary for the secure processing of personal data of customers.

- Shop – an online shop operating at Hendi.com , selling products in its offer.
- Owner – HENDI Polska Sp. z o.o Firmowa 12 street, 62-023 Robakowo.
- Customer account – a field containing data regarding transactions and a tool to process orders placed by the Customer.
- Newsletter – a service provided by the Shop to the User, consisting in sending the User all information about the Shop’s activity to the email address voluntarily provided by the User together with his/her name and surname.
- Consumer – a natural person, who concludes a contract for sale / provision of services with the Entrepreneur, not related directly to his/her business or professional activity.
- Entrepreneur – a natural person, legal person or entity without legal personality, who performs a legal act on its own behalf as part of business or professional activity.
- Entrepreneur, who in certain situations has consumer rights – a customer, who purchases products on the Shop's website as a sole trader, gains the consumer’s right if the product/services purchased at Hendi.com is not of professional nature, resulting in particular from the subject of the business activity performed by the Customer.
- Customer – each entity purchasing products in the Online Shop in accordance with the Terms and Conditions, including the Consumer, Entrepreneur and Entrepreneur who in certain situations has consumer rights.
- Working days – days of week from Monday to Friday, except of public holidays.
- Terms and Conditions – this document, which specifies the terms and conditions of using the Shop and purchasing products.
- In order to use the Shop, the Customer shall have:
- device transmitting ICT data;
- access to the Internet;
- e-mail address;
- software that supports PDF files, e.g., Adobe AcrobatReader.
- The Shops notifies that opt out of cookies by the Customer may affect the functions available in the Shop. After opening the Shop's website, the Customer is asked to accept the Cookie Policy.
- Detailed information about cookies may by found in the Cookie Policy at Hendi.com , which is an integral part of these Terms and Conditions.
- In order to create a “Customer Account”, the Customer registers using the form, providing the login, e-mail address and password.
- The password to login into the Shop may consist of letters, numbers or/and special characters. The password is individual for each user. The password may be changed on the website by entering an e-mail address and a new password. The User is obliged to change the password periodically.
- The “Customer Account” is created free of charge.
- You don’t have to create an account to place an order in the Shop.
- The Customer is obliged to provide true data.
- By accepting the T&C, the Customer makes the following statement:
- I have voluntarily started using the services provided by the Shop;
- the data in the form is true.
- The Customer may not transfer the password to the account in the Online Shop to third parties.
- A registered Customer may:
- access to the status and history of orders;
- receive individual discounts and discount codes;
- receive information about promotions and contests;
- order a Product;
- change personal data;
- change password;
- check orders.
- After registration, the Customer will receive a confirmation link to the e-mail address provided.
- A registered Customer may log into the system.
- The Shop operates 24 hours a day, 7 days a week, enabling the Customer to place an order at any time.
- The Owner verifies the order placed by the Customer. After positive verification, the Online Shop confirms the order in an e-mail sent to the Customer. When the Customer receives such a confirmation, a remote sale agreement is concluded between the parties.
- The massage contains the proposed content of the sale agreement, in particular: number and date of the order, details of the purchased products, price and method of payment, place, method and cost of delivery.
- If the proposed content of the sale agreement is not compliant with the order placed by the Customer, the Customer shall notify the Online Shop about it without undue delay, by sending an e-mail to witaj@hendi.com . with noticed discrepancies. The Online Shop will send the Customer the corrected content of the proposed agreement without undue delay.
- A warranty card of the manufacturer, importer or distributor is attached to the purchased product, if the manufacturer, importer or distributor gives a warranty based on the warranty card.
- In the case of natural persons, the Customers may only be persons with full capacity to perform legal acts.
- The Customer places an order as follows:
- adds selected products to the basket;
- fills up registration or login form and delivery form;
- selects delivery and payment methods;
- confirms the order with the “Buy and pay” button;
- the order confirmation is sent to the Customer’s email address;
- an order placed in electronic form will be confirmed no later than within two working days (excluding holidays) after receiving the order. The confirmation will be sent by e-mail or by phone.
- The Customer may also place an order without registration on the website by:

- by phone during the working hours of the Shop’s customer service: +48 61 658 70 00 .
- The Customer, who places an order in accordance with item 8, without registration on the website, is required to read and accept the Terms and Conditions sent by the Shop to the e-mail address provided by the Customer.
- The Customer, who places an order in accordance with item 8, shall provide:
- name, size, colour and amount of the products;
- name and surname of the recipient, exact delivery address;
- telephone number;
- e-mail address of the ordering party.
- The Customer is obliged to provide true data.
- The Customer can collect the product in person from a designated place.
- The Customer may select a method of payment for an ordered product when placing an order.
- The Customer is obliged to provide correct data for VAT invoice.
- The Customer accepts the issuing and sending of invoices (including correcting invoices) in electronic form. The consent to receive the invoices in electronic form results directly in resignation from receiving invoices in paper form. The Customer may withdraw consent to receive invoices in electronic form, by unchecking the consent in the Customer Account, after logging in to the Online Shop or by contacting the Seller’s Customer Service.
- The prices of the products on the Shop’s website are given in Polish zlotys, including taxes and fees.
- The price of the product before adding to the basket does not include shipping costs and other additional fees. Shipping costs and payment fees are added to the sum of the ordered products. Before placing an order, the Customer is informed about additional costs, e.g., of the packaging.
- The final price of the order, binding for the Shop and Customer, is a price of the product given on the Shop’s website before placing the order by the Customer. The final price is the price of the product including all costs related to the performance of the contract.
- Information about the total value of the order (including shipping costs and payment fees) is available before checking “Order now under payment obligation” and it is confirmed in an e-mail sent immediately to the e-mail address provided by the Customer.
- The ordered products are delivered in a manner indicated by the Customer when placing an order.
- The Customer may organize own transport; however, it is necessary to individually determine the dates, costs and scope of responsibility.
- The Owner determines the delivery date. In case of failure to meet the agreed date, the Customer may give the Seller an additional time. If the products are not delivered within the extended deadline, the Customer may withdraw from the contract.
- The Seller shall be liable for the risk of accidental loss or damage of the products until it is delivered to the Buyer acting as a Consumer unless the Consumer has chosen a different method of delivery than the one proposed by the Shop.
- The products are delivered on working days, from Monday to Friday. The products are not delivered on weekends and holidays.
- The Customer has the right to check the products when delivered. In case of any damage, the Customer shall make a report in the presence of the supplier. The Customer is entitled to submit a complaint or to withdraw from the contract also without such report.
- If the packaging is damaged or tape is torn off, the Customer shall not accept the delivery and shall contact the Seller as soon as possible. The Owner is responsible for the warranty in the case of legal and physical defects of the products in accordance with Article X of these Terms and Conditions.
- The products are delivered in Poland and other European Union countries.
This Article shall apply only to the Customers who are Consumers and Entrepreneurs with consumer rights. (in accordance with definitions in Art. II item 7 of these Terms and Conditions)
- Subject to Art. I item 7 of these Terms and Conditions, the buyer acting as a Consumer may withdraw from the contract without giving any reason, by submitting an appropriate statement in any form within 14 days from the date of delivery of the product. The time limit is considered observed, if the Consumer sends a statement before its expiry to the Seller address:

- If the Customer has chosen a method of delivery other than the cheapest standard delivery method offered by the Owner, the Owner is not obliged to reimburse the Customer for any additional costs incurred by the Customer.
- In case of withdrawal from a remote agreement, the agreement is considered void. Whatever the parties have furnished shall be returned unchanged. The return should be made immediately, not later than within 14 days. The purchased goods should be returned to the following address: HENDI Polska Sp. z o.o Firmowa 12 street, 62-023 Robakowo.
- The direct costs due to the return delivery of the purchased products in connection with the exercise of the above mentioned right, shall be borne by the Customer, unless the Shop agreed to bear the costs or did not inform the Consumer about the right to withdraw from the contract.
- If the Customer withdraws from the contract, the Shop will return the purchase price within 14 days from the date of receipt of the Customer's statement. The purchase prices will be returned to the bank account provided by the Customer. The Shop will issue a written confirmation of return of the purchase price.
- The Customer is obliged to return the products no later than 14 days from the withdrawal date unless the Entrepreneur has offered to collect the products in person. The time limit is considered observed if the product is returned before its expiry.
- A template of the statement of withdrawal from the contract can be found on the Shop’s website and it is attached to the e-mail with order confirmation.
- The Customer shall not have a right to withdraw from a remote contract in the following cases:
- services with the properties specified by the Consumer in the placed order or closely related to Customer’s person;
- services, the subject of which are perishable goods or goods with a short shelf life;
- services, the subject of which is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the packaging has been opened after delivery;
- services, the subject of which are goods that after delivery, due to their nature, are inseparably connected with other goods;
- services that are tailored to the individual needs of the Customer.
This Article shall apply only to the Customers who are Consumers.
- The products offered in the Shop are covered with Seller’s 24-months liability for nonconformity of goods with the contract. It is assumed that if the Consumer submitted a statutory warranty claim to the Seller within 12 months of the product’s delivery, the defect of the product already existed at the time of its delivery.
- The complaint based on the Seller’s liability for nonconformity of goods with the contract shall be submitted:
- by letter to the following address: HENDI Polska Sp. z o.o Firmowa 12 street, 62-023 Robakowo.
- by e-mail to the following address: witaj@hendi.com
- The complaint shall include a detailed description of the type of nonconformity, date of its occurrence, request of the Customer, order number and contact details to facilitate the complaint procedure.
- The Shop considers the complaint immediately, no later than within 14 days after receipt of the complaint sent by the Customer.
- If the Customer does not receive an information about the method of considering the complaint within the time limit specified in item 4, the complaint is considered to be in favour of the Customer.
- If the complaint is relevant, the Customer may request that the product will be brought into conformity with the contract, free repair or replaced with a new product, the price of the product will be reduced, or the Customer may withdraw from the contract. The Shop will reimburse the Customer the equivalent of the price of the entire transaction.
- The response to the complaint will be sent to the e-mail address or correspondence address provided by the Customer.
- The Shop will issue a written confirmation of return of the purchase price.
- A template of the complaint form can be found on the order page and is attached to the e-mail with order confirmation.
This Article applies to the buyers as Entrepreneurs and Consumers.
- The products offered in the Shop are covered by the warranty. The terms and period of the warranty can be found in the Terns and Services, in the product description and on the warranty card.
- The minimum warranty period is 2 years. Certain products have a warranty period of 3 and 5 years.
The warranty claims can be submitted in the complaint and warranty tab at Hendi.com.
- The detailed rules of processing of personal data of Buyers – natural persons – are specified in the “Privacy Policy” which constitutes Annex 2 to these Terms and Services
- The Terms and Services are available at: Hendi.com.
- The Customer may read, download the content of the Terms and Services to end device and print the document.
- The governing law applicable to relations with Entrepreneurs and Consumers is European law and the law of the Republic of Poland. If the regulations applicable in the Consumer’s country are more favourable to the Consumer, and these regulations may not be excluded by agreement, they will apply in this agreement.
- If the buyer is a Consumer, any disputes in connection with these Terms and Services or sale contracts shall be resolved by negotiations, and in case of disagreement, by mediation.
- Both the Consumer and the Entrepreneur are entitled to resolve complaints and pursue claims amicably (i.e., by mediation). The Consumer may resolve disputes amicably by electronic means, e.g. Using the EU platform Online Dispute Resolution (ODR) at http://ec.europa.eu/consumers/odr/
- In case of disagreement by negotiation or mediation with the buyer acting as a Consumer, the jurisdiction of the court is determined in accordance with Regulation (EU) No 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.
- If the buyer is acting as an Entrepreneur, any disputes in connection with these Terms and Services or sale contracts shall be resolved amicably by negotiations or mediation.
- In case of disputes if the buyer is acting as an Entrepreneur, the governing law applicable to the sale contract is Polish law, in accordance with the seat of Hendi.com.
